1. Introduction

Welcome to Dealmoon! We value your privacy and are committed to protecting your personal information. This Privacy Policy explains what information Dealmoon ( “we” or “us”) collects when you use our websites, mobile apps, and related services (“Services”), how we use and share that information, and your rights in relation to your information. It applies to all users except where a regional appendix overrides specific terms. By using any Dealmoon Service, you agree to the practices described in this Policy and our User Agreement (which governs your use of the Services). If you do not agree, please discontinue use.

Controller and Contact: If you reside outside of mainland China, the controller of your personal data is PriceTrace LLC d/b/a Dealmoon, located at 740 E. Campbell Rd., Suite 700, Richardson, TX 75081, USA. If you reside in the European Economic Area (EEA) or UK, Dealmoon's designated representative in the EU is Dealmoon EU B.V., Ludwig-Erhard-Allee 10, D-76131 Karlsruhe in EU (contact: privacyEU@dealmoon.com ). If you reside in mainland China, the controller is 新月亮网络科技(北京)有限公司 (Dealmoon China), located at 北京市海淀区蓝靛厂东路金源时代购物中心2#B座1709室 (support@dealmoon.com). We have appointed a Privacy Officer (Canada/Quebec) and Data Protection Officer (EU) who can be reached at privacy@dealmoon.com for any queries or requests.

2. Information We Collect

We collect information in two ways: (A) information you provide to us directly, and (B) information we collect automatically when you use our Services.

  • (A) Information You Provide: When you register an account, subscribe to newsletters, participate in forums or promotions, or contact us, you may give us personal information. This includes:

    • Identifiers: such as your name, email address, mailing address, telephone number, and username.
    • Account Credentials: password or authentication tokens (stored in hashed form). If you use thirdparty login (e.g. Facebook, Google, Weibo), we collect your third-party account ID and profile info that you authorize.
    • Demographic Info: such as age, gender, and preferences, if you choose to provide them in your profile.
    • User-Generated Content (UGC): any content you post on our platforms (e.g. deal comments, forum posts, images or reviews). (UGC is also addressed in the User Agreement’s content license section.)
    • Loyalty Program Data: if you participate in our points, coins or rewards programs, we collect information such as your point balance, redemption history, and activities (see User Agreement and Program Terms).
    • Communication Records: when you email us, fill out a form, or chat with customer support, we collect the information you submit (and any metadata in the communication).

We will indicate where information is optional. If you choose not to provide certain required information,some features (like account creation or contest entry) may not be available.

  • (B) Information Collected Automatically: When you use Dealmoon Services (web or app), weautomatically collect certain data about your device and usage:

    • Device and Technical Data: IP address, device type, operating system version, browser type, language settings, and unique device identifiers (such as mobile ID or cookie ID). If you use our app, we may collect the device’s advertising ID and, if you allow, precise geolocation (see below).
    • Usage Data: how you use our Services – e.g. pages or screens viewed, time spent, links clicked, search queries on our site, referring webpage or app, and navigation paths. We use analytics tools (like Google Analytics) that log events like clicks, scrolls, and conversions.
    • Cookies & Similar Tech: We and partners use cookies, pixels, and local storage to collect and store usage data. See “Cookies & Tracking Technologies” (Section 5) for details.
    • Transaction Data: If you click an outbound deal link, we may record that click and any resulting purchase (if reported back to us by the merchant or affiliate network). This helps us track deal performance and, in some cases, earn affiliate commission (see Disclaimer about ads). We receive non-identifiable reports from merchants (e.g. how many users bought a product).
    • Location Data: We infer your general location (country, city) from your IP address for content localization. With your permission, our mobile app may collect precise geolocation from your device to provide location-based deal alerts or store finders. We will ask for your opt-in consent via the OS prompts before collecting precise location. You can disable location access at any time in your device settings.

Special Note: We do not knowingly collect personal information from children under the age required by applicable law (see Section 11 “Minors’ Privacy”). For example, in the U.S. we don’t allow users under 13 to register, and in the EEA, under 16 without parental consent.

3. How We Use Your Information

We process personal information for the following purposes (and under the following legal bases, where applicable):

  • Providing and Improving the Service: We use data to create and manage your account, display deals and content, facilitate forum postings, and personalize your experience. For example, we may use your past browsing to recommend deals you might like. (Legal bases: contract performance for registered user features; consent for personalization cookies in EU; legitimate interest in offering relevant content.)
  • Communicating with You: To send service notifications (e.g. account verification, password reset, transactional emails) and respond to your inquiries. Also, with your consent, to send marketing communications such as deal newsletters or promotional offers. You can opt out of marketing emails any time. (Legal bases: contract performance for transactional comms; consent (opt-in) for marketing emails (CAN-SPAM, CASL, GDPR); legitimate interest in customer relations.)
  • Personalization & Analytics: To personalize deal listings and news feed according to your interests, and to analyze usage of our Services (e.g. what sections are popular) to improve features. We may profile users by their site/app activity to segment audiences (e.g. “users interested in Electronics deals”) and improve recommendations. (Legal basis: consent for cookies that track; legitimate interests in improving user experience – with user controls provided for personalized content.)
  • Advertising and Affiliate Revenue: Dealmoon has an affiliate marketing model – some links to third-party merchant sites contain tracking codes. If you click and later purchase, we may receive a commission. We also allow third-party advertising partners to display banner ads or sponsored content. Data (like your device IDs or cookies) may be used to measure ad effectiveness and to avoid showing you duplicate ads . In jurisdictions requiring it (e.g. California), we treat such data sharing for targeted advertising as “sharing” of personal info and honor opt-outs (see Section 8, Your Rights). (Legal basis: consent (where required) via cookie opt-in; otherwise legitimate interest in funding our service through advertising – balanced with privacy, with opt-outs offered.)
  • Loyalty and Promotions: If you join a loyalty or rewards Program (e.g. Dealmoon Points), we use your info to track your points, enable redemptions, and prevent abuse of the program. If we run contests or sweepstakes, we use provided info to administer the promotion (draw winners, deliver prizes) in line with the rules you’ll accept upon entry.
  • Security and Fraud Prevention: To maintain the integrity of our platform, we monitor activities for fraudulent or malicious behavior. For example, we may use your IP and device info to detect multiple accounts or bots, and we log account activities to investigate suspicious incidents. (Legal basis: legitimate interests in protecting our platform and users; compliance with legal obligations to prevent fraud.)
  • Legal Compliance: Where necessary, we process data to comply with laws – e.g., responding to lawful requests by authorities, retaining records as required (tax, accounting), or to exercise or defend legal claims. (Legal basis: legal obligation or legitimate interest in legal defense.)

We will not use your personal information for new, unrelated purposes without updating this Policy and, if required, obtaining your consent.

4. Legal Bases for Processing (EEA/UK users)

(This section applies to individuals in the European Economic Area, UK, or other jurisdictions that require a legal basis for processing.)

Under the GDPR, Dealmoon processes your personal data under the following bases: Contract (Art.6(1)(b)) – to provide the services you requested (account, forum postings, etc.); Consent (Art.6(1)(a)) – for optional activities like receiving marketing or certain cookie usage, which you can withdraw at any time ; Legitimate Interests (Art.6(1)(f)) – to personalize content, secure our platform, and improve our services, only after we’ve balanced these interests against your data protection rights (we will honor opt-out requests and provide transparency to mitigate impacts); and Legal Obligation (Art.6(1)(c)) – when processing is necessary to comply with laws (e.g. retaining transaction records for financial regulations). Where we rely on legitimate interests, if you object (see Section 8.4), we will consider your request and will stop or adjust processing unless we have compelling grounds or it’s needed for legal reasons .

5. Cookies & Tracking Technologies

We use cookies and similar technologies to recognize you and customize your experience:

- What Cookies Are: Cookies are small text files stored on your browser. Pixel tags (web beacons) are tiny images or scripts that load on a page or email and track that action. SDKs are mobile app code for similar tracking.

- Types and Purposes:

Essential Cookies: Required for our site/app to function (e.g. keeping you logged in, remembering your language or region). These do not require consent.

Analytics Cookies: Help us understand site usage (e.g. Google Analytics cookies that collect anonymized traffic data). We use these to improve content and design.

Advertising Cookies: Used by advertising partners to show you relevant ads on our site or elsewhere, and to cap how many times you see an ad. For example, we may allow an ad network to set a cookie to recognize your device so that it doesn’t show you the same banner repeatedly and can report on which ads get clicks.

Affiliate Tracking Cookies: When you click a deal link to a merchant site, a cookie may be set on your browser by the merchant or affiliate network to attribute any resulting purchase to Dealmoon (so we earn commission). These typically last a short time (e.g. 7 days) and only track that you came from us; they do not reveal your identity to us.

  • Your Choices: On our first interaction (especially in EU/UK, as per ePrivacy directives), we will present a cookie consent banner. You can choose which non-essential cookies to accept. You can also adjust your browser settings to refuse or delete cookies (note: essential cookies might be needed for login etc.). For mobile app, check your device settings for options to “Reset Advertising ID” or limit ad tracking. Additionally, you can opt out of Google Analytics with their browser add-on, and out of interest-based ads via industry sites (like aboutads.info). See our full Cookie Policy for more details on specific cookies used.
  • Do Not Track: Our site currently does not respond to “Do Not Track” signals, due to lack of a common standard, but we honor cookie consent choices and Global Privacy Control (GPC) signals as opt-out requests in California (for “sale/sharing” of data) as required by law.

6. How We Share Your Information

Dealmoon is not in the business of selling personal data to third parties for money. However, we do share information in certain scenarios to run our service, with safeguards as described:

  • Affiliated Companies:We may share data with other companies in the Dealmoon Group (e.g., Dealmoon China, Dealmoon UK, etc.) for internal administrative purposes or to provide you with localized services . For instance, if you enter a contest on Dealmoon (US) while in Canada, our Canadian affiliate might assist in prize fulfillment. All Dealmoon entities adhere to this Privacy Policy and comply with applicable laws when handling your data . If any Dealmoon entity jointly determines the purpose of processing your data, we have a joint-controller arrangement (see Section 6.1 below).
  • Service Providers (“Processors”):We use third-party companies to perform certain business operations on our behalf, under contract. Examples: cloud hosting (storing our databases and images), email delivery provider, analytics services, customer support software, payment processors (if any financial transactions), and marketing tools. These providers get access to personal info as needed for their function, but they are not allowed to use it for anything else . We ensure each provider is bound by strict confidentiality and data protection terms. (List of key providers can be provided upon request – e.g. “Amazon Web Services for cloud storage in USA,” “Google Analytics,” etc.)
  • Advertising and Analytics Partners: We may share limited info (like cookies or hashed identifiers) with advertising networks to facilitate targeted ad placement and measurement on our site. For example, we might upload a list of hashed emails to a platform to create a “custom audience” (if we ever do, we’ll obtain consent where required). Or, if an advertiser sponsors a section on Dealmoon, we may give them aggregate stats (“5,000 clicks from NY in April”). We do not share your name or contact info with third-party advertisers without your consent. Some analytics partners (e.g. Google) may act as joint controllers for the data they collect from our site – we will ensure any required jointcontroller terms (GDPR Art.26) are in place.
  • Business Transfers: If Dealmoon undergoes a merger, acquisition, or asset sale, user information (database) might be transferred to the successor entity 68 . If that happens, we will ensure the new owner continues to honor your rights as per this Policy, or we’ll notify you and give an opportunity to opt out of the transfer where required by law.
  • Legal Compliance and Protection: We may disclose personal information if we sincerely believe it’s necessary to: (a) comply with any law, regulation, legal process, or enforceable governmental request (e.g. respond to a subpoena or court order); (b) enforce our Terms of User Agreement or other contracts, (c) detect or prevent fraud, security, or technical issues (e.g. investigate misuse of our site); or (d) protect the rights, property, or safety of Dealmoon, our users, or the public 58 59 . This includes sharing info with law enforcement or regulators if legally required.
  • With Your Consent or At Your Direction: We will share your personal information with third parties if you request or consent to such sharing. For example, if you use a feature that lets you share a Dealmoon deal with a friend (sending via email or social media), we will do so at your direction. Or, if in the future we integrate with a service where you ask us to transfer your data (data portability), we’ll do so with your authorization.

6.1 Joint Controller Note: Certain data sharing may constitute “joint controllership.” For instance, if Dealmoon and a partner jointly determine why and how some personal data is used (e.g. co-hosting an event and collecting sign-ups), we will enter a GDPR Article 26 arrangement with that partner to ensure transparency and allocation of compliance responsibilities . The essence of such arrangement will be available to you upon request, and key points (like who to contact to exercise rights) will be communicated at point of collection.

We do not sell personal information for monetary consideration. In the context of U.S. state privacy laws: Dealmoon does not sell personal data as defined under the CCPA/CPRA without consent. We also do not share personal data for cross-context behavioral advertising except as described for cookies/ads, which you can opt out of (see Section 8 for opt-out rights).

7. International Data Transfers

Dealmoon operates globally; as such, your information may be transferred to and processed in countries other than your own. Primarily, data from all regions is stored on servers in the United States. Additionally, our staff and service providers in China, Canada, the United Kingdom, Germany or other countries may have access to data as needed.

Many of these countries may not have the same level of data protection law as your jurisdiction. However, we take steps to ensure appropriate safeguards:

  • Users in the EEA/UK: If we transfer your personal data out of Europe, we rely on adequacy decisions (if the destination country is recognized by the European Commission as having adequate protection) or, in absence of that, we have in place Standard Contractual Clauses (SCCs) approved by the European Commission, combined with any additional measures needed after risk assessment. For instance, data sent to the US is under SCCs since the US is not currently (as of 2025) deemed adequate. (We are monitoring the new EU–US Data Privacy Framework – if we certify under it, we will update this Policy.) You can request a copy of the relevant SCCs via privacy@dealmoon.com.
  • Users in China: Personal information collected in China is stored in China and is transferred abroad only in compliance with PIPL. We will obtain your separate consent for cross-border transfers of your data (see China Supplement) and ensure the foreign recipient meets the standard of protection required. For example, data to our US servers is under contracts based on the Chinese standard contract clauses (when finalized) or after passing a security assessment if required by CAC.
  • Users in Australia: Before disclosing personal info overseas (e.g. to our US headquarters), we take reasonable steps to ensure the recipient will handle it under standards similar to the Australian Privacy Principles. If an overseas recipient mishandles your info, Dealmoon remains accountable as per Privacy Act s.16C, unless an exception applies (e.g. you explicitly consent after being informed).
  • Users in Canada: Personal data may be transferred outside Canada (e.g. to US or China) for processing. Such data may be subject to foreign laws (e.g. accessible by foreign courts, law enforcement). However, we ensure any processors abroad safeguard the data per our instructions and applicable law. For Quebec residents, we conduct a privacy impact assessment for cross-border transfers that present high risk, as required by Law 25. We also confirm the information will get adequate protection in the recipient jurisdiction, considering factors like sensitivity and legal frameworks (Law 25 Art.17).

8. Your Rights and Choices

Depending on your location and applicable law, you may have some or all of the following rights regarding your personal information. We provide these rights to all users where possible, and region-specific differences are noted:

  • 8.1 Access and Portability: You have the right to request access to personal data we hold about you. We will provide a copy of information in a common format. For EU/UK and soon Quebec (from 2024), you can also request an electronic copy (data portability) of the data you provided to us, which we will supply in a structured, machine-readable format. (For example, a CSV of your profile and activity data).
  • 8.2 Correction (Rectification): You can ask us to correct or update any inaccurate or incomplete personal information. For instance, if your email or phone number has changed, please update via your account settings or request our help. We may verify the new data provided before correction. Under CPRA, we will honor correction requests for Californians; under GDPR/Quebec, rectification is a right as well.
  • 8.3 Deletion (Erasure): You may request that we delete your personal information(and close your account). We will delete or anonymize the data unless an exemption applies. Note: certain data we may retain for legal reasons (e.g. transaction records if you made purchases, or if needed for a legal claim). We’ll inform you if so. California residents have the right to deletion subject to similar exceptions (CCPA/CPRA). In Quebec, you have right to deletion (aka de-indexation or anonymization) as well. To delete your account, you can also use the self-service option in settings or contact support.
  • 8.4 Objection to Processing: If we process your data based on legitimate interests, you can object to that processing on grounds relating to your situation . For example, EU users can object to profiling for direct marketing – if you do, we will stop using your data for that purpose . If you object to other legitimate interest processing (like analytics), we will evaluate if our interests are overridden by your rights; we will either cease or let you know why we must continue (e.g. security reasons).
  • 8.5 Restriction of Processing: You have the right to request we restrict processing in certain circumstances – e.g., if you contest the accuracy of data (until verified) or if you need data preserved for a legal claim but we would otherwise delete it . Restricted data will only be processed with your consent or for legal reasons.
  • 8.6 Withdraw Consent: Where we rely on your consent (e.g. for receiving promo emails or using precise location), you can withdraw hat consent at any time . This will not affect processing already done, but we will stop the future processing. For example, you can unsubscribe from emails (withdraw email marketing consent) or disable location services for the app. If you withdraw consent for a necessary service element, we might not be able to provide that feature (we will advise if so) .
  • 8.7 Opt-Out of “Sale”/“Sharing” (California): If you are a California resident, you have the right to opt-out of the sale of your personal info or sharing for targeted advertising. Although Dealmoon doesn’t sell data for money, we treat certain advertising cookie disclosures as “sharing.” You can use the “Do Not Sell or Share My Personal Info” link on our website footer to record your preference (or send a request via email). We honor Global Privacy Control (GPC) signals as an opt-out request as well. Once opted out, we will (a) stop sharing your data with third-party ad partners except as allowed for service providers, and (b) confirm the change to you. Additionally, Californians under 16 are by default not sold/shared unless they (or their parent/guardian for <13) opt in (we do not knowingly sell/share minor data).
  • 8.8 Limit Use of Sensitive Info (California): If you are in California and we collect “sensitive personal information” (SPI) about you, you can request that we limit its use to strictly necessary purposes. Currently, Dealmoon’s use of SPI (e.g. account login credentials, perhaps precise geolocation) is already confined to providing the Service. We do not use SPI for secondary purposes like targeted advertising. If that changes, we will provide a “Limit Use of My Sensitive Info” option.
  • 8.9 Automated Decisions: (EU/Quebec) If you believe we have made a significant decision about you solely through automated processes, you have the right to request human review of that decision and an explanation. As noted, we generally do not make such decisions (no credit or insurance eligibility decisions, etc.). Personalized content is not legally binding or similar effect. However, we respect this right.
  • 8.10 Data Portability (Quebec from 2024, EU already): Covered above in Access. Quebec’s Law 25 adds that starting Sept 2024, on request, we will provide your data in a structured technological format either to you or directly to a third party you designate, if feasible.

Exercising Your Rights: To exercise any of these rights, please contact us at privacy@dealmoon.com with your request. For certain requests (access, deletion, etc.), we will need to verify your identity to ensure security – this may involve confirming account details or requesting additional info. If you are an authorized agent making a request on behalf of someone (California), we may require proof of your authorization and the consumer’s identity. We will respond to your request within the timeframe required by law (e.g. within 30 days under GDPR/PIPL/Quebec, which may be extendable once; 45 days under CCPA, extendable to 90). There is no fee for making a request, unless it is excessive or unfounded (in which case, we may charge a reasonable fee or refuse, with explanation).

If you have concerns about our response, you have the right to complain to a regulator. For EU users, this is your country’s Data Protection Authority (contact info here). For UK, the ICO. For Canada, the Office of the Privacy Commissioner or your provincial commissioner (CAI in Quebec). For Australia, the OAIC. We would appreciate the chance to address your concerns first, so please consider reaching out to us or our Privacy Officer initially.

9. Security Measures

We take reasonable and appropriate security measures to protect personal data from loss, misuse, unauthorized access, disclosure, alteration, and destruction. This includes administrative, technical, and physical safeguards: for example, we encrypt data in transit (TLS), hash stored passwords, maintain firewalls and access controls, and regularly train staff on data security. We limit access to personal info to employees and contractors who need it for their job and who are bound by confidentiality obligations.

However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security of information. You should also play a part: protect your account credentials and use a unique strong password. If you suspect any account breach, notify us immediately.

In case of a data breach that affects your personal information, we have procedures in place to notify you and the appropriate authorities when required by law. For example, EU users will be notified of certain breaches per GDPR Art.34, and Canadian users per PIPEDA and Law 25, etc., when there’s a real risk of significant harm. We also maintain an incident register as required.

10. Data Retention

We retain personal information for as long as necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by law. For example:

- Account information is kept for the life of your account. If you delete your account, we will delete or anonymize personal data within 30 days, except as noted below.

- Content you post (UGC) may remain as long as the forums are active, unless you delete it or request removal (and it doesn’t violate others’ rights). We may retain server logs and backup copies that contain your deleted UGC for a short period.

- If you participated in a promotion, we may retain winners’ details as required by gaming laws (e.g. 3 years).

- Cookie data: varies – e.g. analytics cookies might persist 6-24 months unless cleared; ad cookies likewise. See Cookie Policy for specific lifespans.

- After you close an account or withdraw consent, we may still retain certain data: to comply with legal obligations (tax, accounting, fraud prevention) or to establish or defend legal claims.For instance, we keep invoice records or support emails for a period required by law (say 7 years). We also retain non-personal aggregate data (which no longer identifies you) for analytics.

When determining retention, we consider the volume, nature, and sensitivity of data, potential risk of harm from unauthorized use/disclosure, the purposes, and whether those can be achieved through other means, and legal requirements. If no justification exists to keep data, we will either securely delete or irreversibly anonymize it.

11. Children’s Privacy

Dealmoon’s services are not directed to children. he minimum age to register and use our forums/ community is 13 years old (or higher, if your jurisdiction sets a higher age for online consent – e.g. 16 in parts of the EU). We do not knowingly collect personal information from anyone under the applicable age. If you are under 13 (or under 16 in the EU, under 14 in China, etc.), do not create an account or send us any personal info. If we learn we have collected personal data from a child under these ages without proper consent, we will delete it.

Parental Responsibility: If you are a parent or guardian and believe your child under 13 (or relevant age) has provided personal info to Dealmoon, please contact us at privacy@dealmoon.com. We will promptly delete the data associated with the child’s account. California minors: If you are a California resident under 18 and a registered user, you may request removal of content you have publicly posted (per Cal. Bus. & Prof. Code § 22581). We will remove (or anonymize) such content upon request, though please note removal might not be comprehensive (e.g., if a post was reposted by others).

12. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make material changes, we will notify users by (for example) posting a prominent notice on our site or sending an email, and updating the “Last Updated” date at the top. In some cases, if required by law, we may seek your consent to significant changes. We encourage you to review this Policy periodically. Your continued use of Dealmoon Services after any update constitutes acceptance of the new terms (to the extent permitted by law).

13. Regional Supplements

(The following Appendices modify or add to the Policy for users in certain jurisdictions. In case of conflict with the global Policy, these local terms prevail for relevant users.)

13.1 California (CPRA) – Additional Notice to California Residents:

This section applies solely to individuals who reside in California. It is intended to comply with the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) and uses terms defined in that law.

- Categories of Personal Information Collected: In the past 12 months, we have collected the following categories of personal information (as defined by CCPA §1798.140): Identifiers (real name, alias, postal address, unique ID, online identifier, IP, email); Internet or other electronic network activity (browsing history on our site, interactions with ads); Geolocation data (general location from IP, precise location if you opted in on mobile); Commercial information (records of products considered via deal clicks); Characteristics of protected classifications (we do not request these, but if you provide info like age or gender in profile, it could infer age range); Inferences drawn from above (profile reflecting preferences). We do not collect sensitive data like social security number, driver’s license, credit card number (except the last four digits if you win a prize), precise health or financial account info.

- Categories of Sources: We collect this info directly from you (when you sign up, post content, or fill forms) and automatically through your use of the service (via cookies, etc.), and indirectly from third-party accounts you link (e.g. if you log in with Facebook, we get your name and email from them).

- Business Purposes for Collection: Correspond to the uses outlined in Section 3 (providing service, marketing, analytics, security, etc.). We do not use personal info for purposes materially different without notice.

- Disclosure for Business Purposes: We have disclosed the above categories of personal information to service providers or contractors for business purposes (e.g. cloud hosting, analytics) in the last 12 months. For example, identifiers and usage data to our analytics provider, IP and cookie to our advertising partners. All such disclosures were to support our operational purposes, not for those parties’ independent use.

- Sale/Sharing of Personal Info: Dealmoon has not sold personal info in the traditional sense (for money). We have “shared” (as defined by CPRA) identifiers (like cookie IDs) and Internet activity with third-party advertising networks for cross-context behavioral advertising. Specifically, third-party ad cookies on our site may collect your browsing info to tailor ads – this is considered “sharing.” You can opt out as described below. We do not have actual knowledge of selling or sharing info of consumers under 16.

- Your California Privacy Rights: You have the right to know (request that we disclose to you) the specific pieces of personal info we have about you, and details about our handling of your data (the categories of info, sources, purposes, third-party disclosures) – essentially, what is provided here and additionally any specific info you request. You have the right to request deletion of your personal info (with exceptions as noted in CCPA). You have the right to correct inaccurate personal info we maintain about you. You have the right to opt-out of sale or sharing of personal info. You have the right to limit use of your sensitive personal info (if applicable). You also have the right not to receive discriminatory treatment for exercising your privacy rights (we won’t deny services or provide different quality of service just because you exercised CCPA rights).

- Submitting Requests: To exercise access, deletion, or correction rights, contact us at privacy@dealmoon.com with subject “California Rights Request”. Describe your request with sufficient detail that allows us to understand, evaluate, and respond. We will verify your identity through your account login (if you submit via logged-in account) or by requesting information matching what we have on file. If using an authorized agent, we require a signed authorization or power of attorney.

Opt-Out of Sale/Sharing: Use the “Do Not Sell or Share My Personal Information” link or GPC signal as described in Section 8.7. Once processed, we will not share your data for advertising, and we will only use service providers who cannot use your data except to perform services for us.

- Retention We retain personal info as described in Section 10; generally, as long as you have an account and as needed thereafter for legitimate purposes (e.g. legal compliance). We specify retention by category above in Section 10 (you may request more info).

- Sensitive Personal Info: We do not use SPI for anything beyond providing the services (e.g. your account password is used only for login security). Thus, while you can request limitation, by default we treat sensitive data with heightened restrictions.

  • Shine the Light Law: Separately, California’s “Shine the Light” law (Civ Code §1798.83) allows customers to request certain info about our disclosure of personal info to third parties for their direct marketing in the prior year. Dealmoon does not disclose personal info to third parties for their own direct marketing. If you have questions, you can contact us as well.

13.2 European Economic Area/UK – GDPR Addendum:

If you are in the EEA, UK, or Switzerland, the following additional terms apply:

- You may contact our EU Representative at Ludwig-Erhard-Allee 10, D-76131 Karlsruhe or our UK Representative at Unit 02 - 137, WeWork, No.1 St Peters Square, Manchester, M2 3DE.

- For any issues, you can lodge a complaint with a Data Protection Authority (e.g., the ICO in the UK, CNIL in France, etc.), but we ask that you give us a chance to address your concerns first.

- We will not transfer your personal data to third countries without complying with GDPR Chapter V (see Section 7). We have implemented measures such as SCCs.

- Joint controllership: As mentioned, if we are joint controller with a third-party (e.g. social media platform for page insights data), per GDPR Art.26 we have an arrangement. For example, for our Dealmoon Facebook Page, Facebook Ireland and Dealmoon are joint controllers for Insights data; the essence of our arrangement is described here. You can exercise your rights in respect of Insights data with either Facebook or us.

- We do not engage in solely automated decision-making that produces legal effects as per GDPR Art.22.

- Legal Bases Recap: We rely on Art.6(1)(b) (contract) to process data needed to provide you the services, Art.6(1)(a) (consent) for things like marketing or certain cookies, Art.6(1)(f) (legitimate interests) as outlined in Section 4, and Art.6(1)(c) (legal obligation) when applicable. For any special category data (likely none except maybe if a user voluntarily posts something revealing (e.g. health in forum), which we don’t purposefully collect), we would require consent under Art.9(2)(a).

- Data Protection Officer: Our DPO (for EU GDPR) can be reached at privacy@dealmoon.com (if applicable).

- Data Subject Rights: In addition to Section 8 rights, EU/UK users also have the right to not be subject to a decision based solely on automated processing (see above), and the right to object at any time to processing of personal data for direct marketing, which we honor (you can also manage email preferences directly). If we ever process data for research or statistical purposes, you could object to that too.

- If we ever intend to further process personal data for a new purpose not originally collected for, we will provide you with information on that purpose and other relevant info beforehand (GDPR Art.13(3)).

- The provision of personal data is partly required by contractual necessity (registration info) – without it, we can’t create an account. In other cases, it’s voluntary (profile fields, etc.). We’ll inform you which is which at collection (e.g. required fields marked *).

13.3 China – P.R.C. Privacy Terms (《个人信息保护法》附录):

If you are using Dealmoon’s mainland China services, the following terms apply, in addition to the main Policy (which is provided in both Chinese and English for transparency, but Chinese version will control for China users):

Sensitive info in China includes things like precise location, personal identifiers, etc., as defined by law. For example, if you link a bank card for a payment, that financial info would be sensitive and we’d ask separate consent.
  • We store personal information of China users on servers within China. If it is necessary to transfer your personal information to a party or server outside China, we will go through required security assessments or certification, and obtain your consent, as described in Section 7. For example, some technical data might be accessed by our US team for debugging – we will ensure it’s done legally.
  • Your rights under PIPL: You can request copies of your personal information (we will provide a portable format as required), and you can request us to transfer it to another processor if feasible (data portability). You can designate a representative to exercise your rights in the event of death (if you want to – PIPL Art.49). To exercise rights, contact our China customer service via the app (“联系我们”) or email support@dealmoon.com. We will respond within 15 working days or as per PIPL. If you disagree with our response, you may lodge a complaint to the Cyberspace Administration or relevant regulator.
  • We will not push personalized content to you if you opt out from receiving personalized recommendations (基于个人特征的定向推送). You can toggle this in your account settings labeled “个性化推荐” – off means you’ll see generic popular content. We will still use basic data to provide the service, but not for tailoring content.
  • If we make any material changes to how we handle personal info (e.g. new purpose, new category of info, or transfer as a result of merger), we will notify you and re-obtain consent as required by PIPL before proceeding.

  • If you have any questions or complaints about our personal information handling, you can also contact support@dealmoon.com, and we will resolve it or revert within a reasonable time.

13.4 Canada – Additional Canadian Provisions:

For individuals in Canada, the following supplements apply:

- If you are in Québec, please note that by clicking “Accept” (or similar) to agree to this Policy or providing us with personal information in connection with using Dealmoon, you are consenting to the collection, use, and disclosure of your personal information as described herein. If you wish to withdraw consent, you may do so at any time (subject to legal or contractual restrictions) by contacting us, but this may limit our ability to provide services. We will inform you of consequences of withdrawal.

- Our files containing your personal info will be kept at our offices or on our servers (or those of our service providers) and will be accessible to our authorized employees, contractors, and agents who require access in connection with their duties. To request access or correction, see Section 8 – you may also write to our Privacy Officer at the postal address listed above. We will respond within 30 days as per PIPEDA.

- In Québec, you have the right to request information about the names of third parties or categories of third parties outside Québec to whom we have disclosed your information, which we provide in this Policy (e.g. “cloud service in USA, etc.”). you also have the right to object to certain disclosures of your info outside Québec by demonstrating to the CAI that such disclosure would cause you serious injury. (We believe our safeguards prevent such injury.)

- We collect, use, and disclose your personal info with your consent, except where otherwise permitted or required by law. In practice, by providing your info and using the service, you consent. We may also rely on deemed consent for purposes that a reasonable person would consider appropriate in the context (e.g. using your email to send an order confirmation you requested). Where required, we will seek express consent (e.g. for sensitive items or new purposes).

- We do not “sell” personal information as defined in some provincial laws (no monetary consideration exchange). If we ever share data with third parties for new purposes, we will seek consent.

- If we engage in “automated decision-making” that falls under Quebec’s definition (fully automated process that produces a decision concerning you), we will inform you of this and your right to have the decision reviewed. (See section on Automated Decisions above.)

- In the event of a security incident involving your info that poses a “risk of serious harm”, we will notify you and the Privacy Commissioner of Canada (and CAI for Quebec) as required by law. “Serious harm” could include bodily harm, financial loss, identity theft, damage to reputation, etc. We maintain records of all data breaches even if not notifiable.

13.5 Australia – Additional Australian Provisions:

For individuals in Australia:

- Dealmoon complies with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Policy outlines how we meet APP 1 (Open and transparent management of info).

- You may contact us at privacy@dealmoon.com for any questions or requests. We aim to respond promptly.

- Cross-border: As noted, your data may be transferred outside Australia (to US, etc.). By using Dealmoon, you consent to us disclosing your personal information to overseas recipients as described. While these recipients are subject to contracts to protect your data, please note: if they are not governed by Australian law, the recipient may not be bound to Australian Privacy Principles and you may not be able to seek redress under Australian law. However, under APP 8.1, Dealmoon remains liable as stated if the overseas recipient mishandles the data (unless you consented to the transfer despite this, which this clause constitutes as informed consent of cross-border disclosure). We believe our measures (SCCs etc.) provide comparable protection.

- Access & Correction: You have the right to access the personal info we hold about you and request corrections if needed. Section 8 covers this. We may ask you to verify identity and let you know if any charge applies for providing access (usually no charge for straightforward requests). We will give access within a reasonable time. If we refuse access (permitted only in limited circumstances like unreasonable impact on others’ privacy or frivolous request, per APP 12), we will give you a written notice with reasons and how to complain. For correction, if we refuse to correct, we will annotate what you contested if you request.

- Complaints: If you believe we have breached your privacy under Australian law, contact us with details of the issue. We will investigate and respond in writing within a reasonable time (30 days). If you are not satisfied, you can escalate the complaint to the Office of the Australian Information Commissioner (OAIC).

- Direct Marketing: We will not use your info for direct marketing (like promotional emails or SMS) without your consent or beyond what you reasonably expect. You can opt out as described. We include unsubscribe options in communications.

- Government Identifiers: We do not use or disclose any government identifiers (like TFN, Medicare number) as we do not collect them.

- Anonymity: You have the option to use Dealmoon anonymously or under a pseudonym, for example by browsing deals without logging in, or using a nickname in forums. However, for certain functionalities (posting deals, earning rewards, contacting support), we do need to know who you are. We will inform you when identification is required.
